GenoVive Product Usage and Customer Service Policies
GenoVive prohibits participation by persons under the age of 18, women who are pregnant or nursing, individuals with an active diagnosis of an eating disorder of anorexia or bulimia nervosa, individuals who are allergic to nuts, and individuals with certain medical conditions. Without explicit permission from ones medical doctor determination of eligibility relies on truthful and accurate answers to the questions asked on the initial order form filled out at the time of purchase of the DNA test kit. All DNA test kit orders and first month of meal plan orders must be approved by GenoVive’s Physician of Record before being shipped. If the patient does not meet the eligibility criteria, the Physician of Record will not approve the order and will be notified via email. You will not be billed for any orders not approved by the Physician of Record.
Geographic Exceptions: Residents of the states of New York and Maryland are not yet eligible to order GenoVive products because of additional certification requirements, specific to New York and Maryland, which GenoVive is currently in the process of completing.
Protecting Your Privacy
All of GenoVive’s information about your patient is provided by you. When you register on GenoViveUSA.com or order form, you are responsible for providing truthful and accurate information to all of the questions asked by GenoVive including your patient’s full name, email address, username and password. When you choose to become a GenoVive customer and order products, you are responsible for providing truthful and accurate information to all questions asked by GenoVive including your full name, gender, ethnicity, height, weight, date of birth, address, phone number and answering a series of health and lifestyle questions.
In addition to the information you provide to us through online forms, you may choose to correspond with GenoVive via email or by phone. In this case, we may save the content of your email messages or phone conversation together in a file with your personal information. This information will also be safeguarded and will not be shared with any third parties at any time.
All personally identifiable information you provide to us in confidence will not be shared outside of GenoVive without your permission.
What Online Information Do We Track
Like other commercial websites, GenoVive uses standard cookies and webs server logs to collect information about how our website is used. This information may include date and time of visits, pages viewed, time spent on the site and entry and exit websites. This information is collected on an aggregated basis and is not associated with you as an individual. We use this non-personal information gathered from cookies and web server logs to analyze trends about the use of our website and to help improve and develop new features for our website.
How We Use Your Information
The information collected about your patient by GenoVive is used to approve, process, ship and track orders. We may send you emails for order tracking purposes or communicate other information about your account to you via email.
The DNA Test and Results
All DNA samples are processed in our CLIA certified lab. The DNA sample will be tested only for specific genetic markers related to weight loss and weight management as specified in GenoVive’s patent pending proprietary process. The GenoVive Nutrition and Fitness Genetic Profile Report will contain the results of the DNA test and will be available to you via WatchDox portal. You may choose to download and save the PDF file on your computer for future reference. This information will remain confidential. If you choose to contact GenoVive by phone or email with questions about the DNA test results or the information contained in the report, you will be asked to verify your identity according to HIPAA guidelines. After the DNA test results have been confirmed, the DNA sample will be destroyed according to HIPAA guidelines.
Federal Laws Protecting Your Patients
Some people worry that once they know a genetic fact about themselves; they could be forced to share that information with an insurer or employee. The United States instituted a new law on May 21, 2008 called the Genetic Information Nondiscrimination Act (GINA), which protects Americans against unfair treatment from employers and insurers on the basis of genetic information. As a result, your patients are NOT required to disclosure genetic information to an employer or insurer, nor can they be legally discriminated.
Withdraw of Consent
If your patient decides that they do not wish to proceed with a nutrigenetic screening DNA test after submitting cheek swabs, they must contact GenoVive LLC within two (2) days after mailing your cheek swabs to stop the genetic test or five business (5) days after mailing their cheek swabs to stop receiving the results. If your patient choose to cancel the genetic test or do not want to receive the test results, their sample will be destroyed. Your patient will not be eligible a refund after submitting their cheek swabs.
Important Health Information
Please have your patient consult a physician before beginning any diet or exercise program. The information provided by GenoVive and contained in this website, including an individual’s results of the GenoVive Nutrition and Fitness Genetic Test, is not intended to prevent, diagnose or treat any medical condition and should not replace the advice of a physician. If your patient experience pain or physical difficulties while eating a reduced calorie diet or during exercise, please have them stop and contact their physician immediately.
If your patient is currently being treated for any illnesses or medical conditions, taking prescription medication or following a doctor recommended diet, it is essential for them to consult with their physician before starting the GenoVive program and to follow up with their physician on a regular basis after they start losing weight. Losing weight and eating a reduced calorie diet may create physical changes that should be monitored by a physician. If your patient is on a prescription medication, losing weight or eating a reduced calorie diet may require a change in their treatment program or medication dosage.

Your Responsibility to Follow the GenoVive Program Guidelines
GenoVive’s daily meals have been designed to be nutritionally complete and provide your patients with the right amount of nutrients and calories to sustain a safe, healthy weight of weight loss while maintaining their energy each day. While on the GenoVive meal program, it is important to eat all of the food provided in the daily meal kits and follow all program guidelines as specified. Failure to follow the program protocol may change the weight loss progress and could cause side effects due to a lack of essential calories.
The GenoVive exercise program has been designed to help your patients lose weight in conjunction with the GenoVive foods they eat while on the program. Proper exercise is important to achieve results in our weight loss program. Please consult your physician before beginning an exercise program. If you have any doubts about your physical capability to perform any suggested exercises, please do not attempt those exercises without consulting your physician.
Food Availability and Substitutions
GenoVive will take great care to assure that we have sufficient inventory to fill your order in a timely manner. Your patient will not be billed until the food is shipped. Due to popular demand or shipping delays from our food suppliers, there may be times when substitutions or changes to the menu need to be made. In this case, the substituted items will meet the nutritional criteria of your patient’s meal program.
The foods in GenoVive’s meal program include a variety of meats, vegetables, fruits and whole grains. Persons with nut allergies are ineligible to order GenoVive products. At this time, GenoVive does not have a meal program that accommodates nut allergies or other special dietary needs such as vegetarian or gluten free. Special dietary needs meal programs may be developed in the future.
GenoVive will grant a refund only on the first order of monthly meal program. If your patient chooses to return the food, they must notify GenoVive by phone at 1-855-DNA-MEAL within 7 days after receiving their food shipment. Your patients are responsible for shipping any unused food back to GenoVive before refund will be processed. Your patients will be refunded the amount they paid for the food only and not any shipping charges.
